A Court appointed Deputy will continue in their role until such time as the Court makes a further Order discharging them of their duties or where the Patient ceases to lack capacity or dies.
If either of this happens, steps may need to be taken to finalise the court’s involvement in the Patient’s affairs e.g. application to end proceedings or for final directions (including discharging an order appointing a deputy or discharging the security) may be made following the Patient’s death.
The Public Guardian may require a Deputy to submit a final report upon the Patient ceasing to lack capacity or the Patient’s death. If security has been ordered by the Court, the Court must be satisfied that the Public Guardian either does not require a final report or is satisfied with the final report provided by the deputy before the said security can be discharged.
