Yuen Law has been shortlisted as finalist for the prestigious Regulatory Law Firm of the Year award at the Asian Legal Business (ALB) Pan Asian Regulatory Summit Awards 2023/2024.

We are known for our expertise in effectively navigating intricate regulatory laws and compliance requirements, particularly those under the Payment Services Act (PSA) and Securities and Futures Act (SFA).

The firm advises licensed financial institutions, financial advisers, payment services providers, credit card issuers, fintech companies, digital token issuers, digital asset exchanges, trading platforms, and remittance companies in licensing requirements overseen by the Monetary Authority of Singapore. This includes Major Payment Institution licence, Standard Payment Institution licence, and where applicable, offering legal opinions on the viability of relying on exemptions under the PSA and SFA. We also assist in obtaining Capital Markets Services (CMS) licences, and support innovative business entry into the MAS Fintech Regulatory Sandbox.

In the area of investment funds,  we advise fund managers, funds, limited partners and family offices on fund management licensing and registration, the formation of fund structures and Variable Capital Companies (VCC), and the preparation of fund documentation, including private placement memorandums and subscription agreements.

Among Yuen Law’s recent, noteworthy fintech and regulatory finance cases:

  • Represented one of the pioneers of robo-advisory and fund management services in Singapore, providing regulatory advice, and assisting in the application to amend the scope of its Capital Markets Services licence.
  • Represented a financial institution whose shareholder is a listed company in China, on various matters, including its application to the Monetary Authority of Singapore for a Major Payments Institution licence under the Payment Services Act.
  • Represented an Australian-based company, we opined on three tokens offerings which are backed by physical goal. We advised if the tokens would be construed a Capital Markets Product under the Securities and Futures Act or Digital Payments Token under the Payments Services Act.
