‘The Reasons for Divorce’ a.k.a Divorce Requirements

The Court has the power to terminate your marriage if it is satisfies that there has been an irretrievable breakdown of your marriage.  To prove this you must show that ONE of the following (section 95(3) of the Women’s Charter):

  1. ADULTERY: your spouse has committed adultery, and you find it intolerable to live with your spouse.
  2. UNREASONABLE BEHAVIOUR : your spouse has behaved in such a way that you cannot reasonably be expected to live with your spouse.
  3. DESERTION : your spouse has deserted you for at least two years and does not intend to return.
  4. LIVING APART 3 YEARS : if your spouse agrees to the divorce, that you and your spouse have been separated for at least 3 years.
  5. LIVING APART 4 YEARS : if your spouse does not agree to the divorce, that you and your spouse have been separated for at least 4 years.
