Where do I find a Certificate Issuer?

A Lasting Power of Attorney (“LPA”) certificate issuer can be any one of the following:

    • a medical practitioner accredited by the Public Guardian;
    • a registered psychiatrist; or
    • an advocate and solicitor of the Supreme Court who has in force a practising certificate under the Legal Profession Act (Chapter 161) of Singapore.

The role of the certificate issuer

The certificate issuer is important as without a certificate issuer, you will not be able to make an LPA. The certificate issuer will explain the terms and implications of an LPA to you and sign on the LPA form as a witness.

The certificate issuer will certify that:

    • you understand the purpose of the LPA and the scope of authority that you will be conferring upon your appointed donee(s);
    • no fraud or undue pressure is being used to induce you to make an LPA; and
    • there is nothing else that would prevent the LPA from being made.

To avoid possible conflicts of interest, the following persons should not be your certificate issuer:

    • a donee or replacement donee appointed under the LPA or any other LPA made by the donor (whether cancelled or not);
    • a family member of such donee or replacement donee;
    • a director or employee of such donee or replacement donee who is a licensed trust company;
    • a business partner or employee of the donor or such donee or replacement donee;
    • the owner, director, manager or employee of the care facility where the donor resides or is being cared for, or a member of his family.
